Matchpoint Therapeutics, Inc (the “Company”, “We,” or “Us,”) respects the privacy of your personal information. This policy explains the collection and use of data in conjunction www.MatchpointTx.com (the “Website”). By using the pages of the Website, you agree to the practices described in this Privacy Policy. If you do not agree to the terms set forth herein, do not use the Website. 

This site may contain links to third-party websites over which the Company maintains no control and therefore takes no responsibility regarding privacy considerations or content. 

Collection of personal information 

We may ask you on this site for information that personally identifies you or provides information about yourself (“PI”) or allows us to contact you to provide a service or a product that you have requested (such as requesting information about our company). The PI we collect may include your name, your address, your telephone number, your email address and other contact information, and other information about services requested through the Website. You are not required to provide the PI that we have requested, but, if you choose not to do so, in many cases we will not be able to provide you with our services or respond to questions you may have. 

The Website may also collect information about your visit, such as the name of the Internet service provider and the Internet Protocol (IP) address through which you access the Internet; the date and time you access the Website; the pages that you access while at the Website and the Internet address of the website from which you linked directly to the Website. 

Use of PI 

Except as otherwise required by law, the PI collected on the Website will only be for the following purposes:  

  • To operate the Website and to provide the service(s) and/or product(s) or carry out the transaction(s) you have requested or authorized  
  • To improve the Website and any related Company products or services  
  • To make the Website easier to use by eliminating the need for your repeated entry of the same information. 

When you visit the “Careers” portion of our website, we collect the information that you provide to us in connection with your job application. This includes business and personal contact information, professional credentials and skills, educational and work history, and other information of the type that may be included in a resume. This may also include diversity information that you voluntarily provide. We use this information to facilitate our recruitment activities and process employment applications, such as by evaluating a job candidate for an employment activity, and monitoring recruitment statistics. We may also use this information to provide improved administration of the website, and as otherwise necessary (a) to comply with relevant laws or to respond to subpoenas or warrants served on us; (b) to protect and defend the rights or property of us or others; (c) in connection with a legal investigation; and/or (d) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms of Service.

From our Website, you may use third party social media widgets/tools/buttons. If you use that functionality, your use is subject to the third party’s privacy policy and terms. As with all links to non-Company websites/content/services, we recommend that you read the privacy policies and terms associated with third party properties carefully.

How we share information 

The Company may hire other companies to provide services on our behalf, such as web hosting, web design or technical support. We will only provide those companies the PI they need to deliver the service. They are required to maintain the confidentiality of the PI and may only use that information for the specific purpose for which they have been engaged. For example, the Company may share data:  

  • In coordination with firms that have been hired to help the Company in processing job applications
  • In response to lawful requests by public authorities 
  • Where necessary to protect Company, your vital interests, such as safety and security, or those of another person 
  • To seek legal advice from external lawyers and advice from other professional advisers 
  • As necessary to establish, exercise or defend against potential, threatened or actual litigation.
  • In connection with the sale, assignment or other transfer of all or part of our business 

Control of PI 

Except as otherwise described in this Privacy Policy, your PI will not be shared outside of the Company. 

For persons over the age of 18, providing information about yourself through the Website is free and completely voluntary. No information should be submitted to or posted to the Website by any person under the age of 18 years. If the Company determines that contact information has been submitted by a person under age 18, such information will be removed. By submitting your contact information through the Website, you represent that you are age 18 or over. 

Retention 

We will only retain your personal data for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying legal, accounting, or reporting requirements. We are a United States-based company, and as such you expressly consent to the transfer and storage of your personal data collected through the website to anywhere in the United States where we maintain facilities. In some circumstances we may anonymize your personal data (so that it can no longer be associated with you) in which case we may use this information indefinitely without further notice to you.   

Security of PI 

The Company is committed to security of your personal data. When you submit personal data on the Website, the Company will take all reasonable efforts to protect it. The Company uses certain security technologies and procedures to help protect your PI from unauthorized access, use, or disclosure once it is received. Although we implement reasonable measures designed to protect personal data from unauthorized access, we cannot ensure the security of any information you transmit to or guarantee that this information will not be accessed, disclosed, altered, or destroyed. We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored personal data.

Upon your acceptance of cookies on our Website, we may collect information about your visits to the Website without you actively re-submitting acceptance of cookies. The remainder of this section assumes that either the use of cookies is not restricted by applicable law or if it is restricted the individual has explicitly consented to the use of cookies. We reserve the right to update this Privacy Policy from time to time and without notice to you. Your continued use of the Website constitutes your agreement to this Privacy Policy, as amended from time to time. 

Coordination with Terms of Use 

This Privacy Policy is intended solely to clarify the Company’s practices with respect to PI and shall not in any way modify or limit the legal effect of the Terms of Use of the Website. In the event of any conflict between this Privacy Policy and the Terms of Use, the Terms of Use shall prevail. In particular, the Company will not be liable for any damages or injury (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) that result from your use of the Website or your submission of PI through the Website, even if there is negligence on the part of the Company or its employees. In addition, you agree to defend, indemnify, and hold the Company, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable attorneys’ fees, resulting from, or alleged to result from, your submission of PI to the Website or your unlawful collection of PI of others through use of the Website. 

Governing law and venue 

This Privacy Policy shall be governed by and interpreted in accordance with the laws of the Commonwealth of Massachusetts. Any dispute relating to this Privacy Policy shall be resolved solely in the state or federal courts located in the Commonwealth of Massachusetts.

California Consumer Privacy Act Notice 

Pursuant to the California Consumer Privacy Act of 2018 (“CCPA”), we may collect the following categories of PI: 

  • Identifiers, such as name and government-issued identifier (eg, Social Security number) 
  • PI, as defined in the California safeguards law, such as contact information 
  • Characteristics of protected classifications under California or federal law, such as age, and gender
  • Internet or network activity information, such as browsing history and interactions with our websites 
  • Geolocation data, such as device location 
  • Professional or employment-related information, such as work history and prior employer 

We may use this PI to operate, manage, and maintain our business, to provide our products and services, for our employment purposes, and to otherwise accomplish our business purposes and objectives. Our business purposes and objectives include, for example, developing, improving, repairing, and maintaining our products and services; conducting research, analytics, and data analysis; maintaining our facilities and infrastructure; undertaking quality and safety assurance measures; conducting risk and security controls and monitoring; detecting and preventing fraud; performing identity verification; complying with law, legal process, and internal policies; maintaining records; and exercising and defending legal claims.

For purposes of this CCPA Notice, “sold” or “sale” means the disclosure of PI for monetary or other valuable consideration but does not include, for example, the transfer of PI as an asset that is part of a merger, bankruptcy, or other disposition of all or any portion of our business. 

If you are a California resident, you may request that we: 

  • Disclose to you the following information covering the 12 months preceding your request: 
  • The categories of PI we collected about you and the categories of sources from which we collected such PI 
  • The specific pieces of PI we collected about you 
  • The business or commercial purpose for collecting PI about you 
  • The categories of PI about you that we otherwise shared or disclosed and the categories of third parties with whom we shared or to whom we disclosed such PI 
  • Delete PI we collected from you

In some instances, we may decline to honor your request where an exception applies, such as where the disclosure of PI would adversely affect the rights and freedoms of another California resident. 

You have the right to be free from unlawful discrimination for exercising your rights under the CCPA.
